Our team has experience with a multitude of customized, shrink-wrap, and Commercial Off-the-Shelf software and applications. The software spans a number of major developers, integrators and software manufacturers, including the “Big Four” Consulting Firms, EDS, IBM, Accenture, SAP, Oracle, PeopleSoft, J.D. Edwards, JDS, and most of the operating systems of major hardware platforms. Our team has experience and expertise with a wide range of hardware and systems platforms, including IBM, DEC, HP, Compaq, Hitachi Data Systems, Amdahl, NCR, and virtually all of the other major manufacturers.

We provide two distinct yet highly complementary services:

1) Expert Witness Opinions, and
2) Management Consulting.

Our expert opinions are grounded in our extensive hands-on experience in the field leading project initiatives and providing management consulting advice to project leaders and corporate executives. When we testify, we speak with credibility and persuasiveness because we’ve been there, contracting for large systems engagements, managing them, developing methodology, programming code, implementing testing, conducting conversion, running training, assuring quality, putting into place post-implementation processes, organizing IT department staffing and operations, and using the end products.

At the same time, our management consulting advice is informed by the insights revealed through the intense lessons-learned perspective of litigation in which opposing legal teams do their best to attribute fault to the opposite side. Based on such perspective we can present a road map around some of the legal land mines and save time and money for your organization.

Expert Witness Services

An expert witness should exemplify two qualities: 1) the capacity to understand complex facts, issues and technology, and 2) the ability to explain these in a straight-forward yet compelling manner. WSRcg excels in both qualities. Our expert opinions are thorough, clear and easy to understand – in a word, they are persuasive. We handle cross-examination in court with poise because we understand the issues and we have the experience and expertise to backup what we say.

WSRcg consultants have acted as special masters, consultants, expert neutrals and expert witnesses in legal matters including: business failures; officer and director liability: antitrust matters; systems acceptance and performance issues; contract matters; intellectual property misappropriation; royalty issues; business litigation; damage models and theories; insurance matters; and project management. As independent experts we have worked with attorneys representing plaintiff and defendant software developers, systems consultants, systems integrators and customers.

With our extensive experience working with an array of lawyers, we understand the legal process and we appreciate what legal teams need. At the same time, we fiercely protect our credibility, which is good for the case of the clients whose lawyers hire us. We are not afraid to tell the client and their lawyers where their case is weak, unsupported, or simply lacking in merit. However, where there is merit and good cause in a client’s case, we can deliver a riveting and convincing opinion that allows the court and jury to make the right decision with confidence. The synergy between our incisive expert opinions and the attorneys' legal strategies typically results in larger and speedier settlements, as well as more favorable resolutions and judgments in trial situations.

System Failure Litigation

WSRcg provides expert witness services for litigation involving large-scale system project and software failures. We have provided opinions or testimony in such matters in North America, Europe, Asia, and in courts at all levels including US Federal Courts, Superior Courts, and the Court of Federal Claims, and in arbitration and mediation. As pioneers in the areas of systems development methodology, systems testing and acceptance, systems contracts, and large-scale systems project management, WSRcg experts use their particularly lengthy experience and strong expertise to quickly uncover the root causes of why a system and/or project has failed in terms of quality, cost, schedule, functionality and performance. We have learned over the years that there are less than ten things altogether responsible for such failures (and successes). While in most cases all parties contribute to a failure, courts typically hold one party more responsible than the others, and often the determination of liability can be counter-intuitive. To help the court correctly attribute the primary blame for the failure, it is important to carefully identify the root cause of failure, which itself depends on the degree to which each of the ten forces and related decisions played a role in shaping the events of a project.

Intellectual Property Litigation

In addition to our expert witness services regard ing large -scale systems and project failures, WSRcg provides investigative and forensic services, and expert opinions in the areas of intellectual property infringement and misappropriation regarding technology patents, copyrights, trade secrets and idea submissions. In today’s development environment, dominated by fourth-generation languages, code-generation tools, CASE tools, open source code, reusable objects and more, this forensic work requires more skill and judgment than ever before. WSRcg consultants draw on their vast experience, expertise and education, along with the proper forensic automated tools and a proprietary step-down methodology to flush out critical “similarities” that can uncover and address the tipping points in a case.

Management Consultant Services

Computer Technology Consulting

WSRcg provides timely consulting advice regarding a wide range of computer technology issues and problems. WSRcg has been responsible for overseeing more than 100 systems in 15 industries for companies of all sizes, including overseeing the testing, implementation, acceptance, and development of controls for the LOTTO lottery games for the State of California. We have covered virtually all aspects of computers and technology including:

  • the systems development life cycle, (i.e., requirements development, system selection, contracting for, programming, and analyzing, designing, testing documenting, converting and implementing successful systems solutions);
  • working with high-technology companies to raise equity capital and financing;
  • assisting companies in developing appropriate high-technology contracts for acquisition, distribution, development support, and protection of intellectual properties and rights.

With our extensive experience working with a wide range of software companies, we know how to appraise the value and the long term viability of software companies.

Business and Management Consulting

Through business and management consulting, WSRcg helps companies improve both their long-term and short-term positioning and profitability. Project Steering Committee Services

WSRcg's experienced team can bridge the gap for Board members and executive managers who either do not have the time to closely monitor systems development projects in their companies, or who need additional mentoring to understand the complex technology and project issues. By being the Board’s eyes and ears on a project, we can augment the Board’s and executive management’s crucial oversight of a project. We ensure that the project manager is acting effectively in directing the day-to-day functions of the project team. We make sure that project communication is flowing freely, that risk management practices are in place, that quality control and assurance are being addressed, and that roadblocks are not prohibiting progress toward the project's objective.

Failure statistics for technology projects are gloomy with less than twenty percent of projects, by some counts, on average delivering on target. The larger the project, the more likely it will fail, and the more costly the failure will be. Our Project Steering Committee Services can mitigate much of the risk by directing project management around typical pitfalls, supporting executives in addressing pressing project problems, and giving executive management the important information they need to properly steward these vital company assets.
